Management of cookies according to the Guidelines of the Guarantor Authority for the protection of personal data issued on 10 June 2021

Need

The company, a Milan-based company specialized in reading and analyzing information relating to the financial health of companies, requested the support of Service Line Digital e Innovation Warrant Hub S.p.A. to correctly manage, from a regulatory point of view of GDPR compliance, the reporting of a interested who, after landing on their company website, informed them that they did not comply with the Guidelines on cookies of the Guarantor Authority for the protection of personal data. Therefore, he ordered the company to remove his data as they were processed for purposes for which consent had not been requested.
Finally, the interested party reported the incident to the Privacy Guarantor.

Solution

Our intervention developed in several phases.
An inspection of the company website was launched using the PrivacyLab platform, which output all the cookies and beacons present within the analyzed domain.
The Privacy Guarantor, with the issue of the Guidelines on cookies on 10 June 2021, indicated which rules to apply to read and write operations within a user's terminal, with reference to the use of cookies and other tracking tools. , specifying the correct methods of acquiring the online consent of the data subjects in light of the full application of the GDPR. In particular, in line with the principle of privacy by design, the acquisition of consent must ensure that cookies other than technical (e.g. from third parties) or other means of tracking are not installed on the user's device.
The aim of the measure was therefore to strengthen the decision-making power of users regarding the use of their personal data when they surf online.
Our support developed as follows:

  • inspection of the site and detection of cookies and other tracking tools present on the same
  • schematization of cookies at the level of processing and verification of lawfulness
  • definition of the purposes and of its correct legal bases, including storage times
  • indication of any transfers abroad of the data of the user landed on the website
  • creation of the extended information and creation of the dynamic banner to be made visible on the site in order to allow the user to decide whether or not to install the cookie.
